Terms of Service

1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your use of the website operated by Shipyard Productions, LLC DBA American Contractor Leads (“we,” “us,” or “our”). By accessing or using the site or submitting a request through it, you agree to these Terms. If you do not agree, do not use the site.
2. What We Do
American Contractor Leads is a lead-generation service. We generate local service requests and connect the people who submit them (“Prospects”) with independent contractors (“Contractors”) in the requested trade and area. We are not a contractor, we do not perform contracting work, and we are not a party to any agreement, transaction, or dispute between a Prospect and a Contractor.
3. Eligibility
You must be at least 18 years old to use the site. By using it, you represent that you are 18 or older and able to enter into these Terms.
4. Use of the Site
You agree not to:
- Use the site for any unlawful purpose or in violation of these Terms;
- Submit false, misleading, or fraudulent information;
- Scrape, harvest, or copy site content except as expressly permitted;
- Interfere with, disrupt, or attempt to gain unauthorized access to the site or its systems; or
- Infringe the rights of any other person or entity.
5. For Prospects: How Leads Work
When you submit a request, we may deliver your information to a Contractor so they can contact you. Your calling and texting consent is described in our Privacy Policy. We do not guarantee that any Contractor will contact you, provide a quote, or perform work, and we do not guarantee any particular price, timing, or result. Contractors are independent businesses. We do not endorse, employ, warrant, or supervise any Contractor, and we are not responsible for the work they perform.
6. For Contractors: Leads and Payment
A Contractor’s purchase and use of leads is governed by the separate Contractor Agreement between that Contractor and us. If anything in these Terms conflicts with the Contractor Agreement, the Contractor Agreement controls as to that Contractor. Leads are sold on a pay-per-lead basis. We do not guarantee any amount of revenue, number of closed jobs, or return. Each Contractor is solely responsible for its own legal and regulatory compliance, including licensing and its own communications with Prospects.
7. Intellectual Property
The site and its content — including text, graphics, logos, and design — are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to view the site for its intended purpose. You may not copy, reproduce, or reuse our content without our written permission.
8. Disclaimers
THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LEAD OR CONTRACTOR WILL MEET YOUR EXPECTATIONS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Shipyard Productions, LLC and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the site, your violation of these Terms, or your violation of any law or the rights of another.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the state or federal courts located in Indiana, and you consent to the personal jurisdiction of those courts.
12. Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. These Terms, together with our Privacy Policy — and, for Contractors, the Contractor Agreement — make up the entire agreement between you and us regarding the site.
